The two Emirati common-law jurisdictions offer sophisticated ADR options. Here's how to think about them.
The DIFC in Dubai and the ADGM in Abu Dhabi are both English-language, common-law free zones with dedicated courts and sophisticated dispute-resolution infrastructure. For international parties they are natural venues, but they are not identical, and the choice between them matters.
DIFC Courts and DIFC-LCIA
The DIFC Courts are experienced with cross-border commercial matters and have a long-standing arbitration tradition through the DIFC-LCIA (now the Dubai International Arbitration Centre). Judgments are enforceable in onshore Dubai and, increasingly, internationally.
ADGM Courts and its arbitration centre
ADGM applies English common law directly, unusually explicit for the region. Its courts and arbitration framework have been designed to feel familiar to London practitioners. The ADGM Arbitration Centre offers a modern, English-facing rulebook.
Choosing between them
Choose based on the counterparty, the assets in play and the enforcement route. Both jurisdictions support pre-arbitral mediation, and both recognise the Singapore Convention's enforcement regime for mediated settlements.
The bottom line
Both jurisdictions are serious, sophisticated venues. The right choice is rarely obvious from the contract alone, it depends on what you would need to do if the dispute escalates.
